ECO ADDITIONS PTY LTD - TERMS AND CONDITIONS OF SALE
In these Terms and Conditions:
"we, our, us, Eco Additions Pty Ltd" refers to Eco Additions Pty Ltd, www.ECOADDITIONS.com.au
"Your, You, customer, purchaser" refers to a person who purchases Products from Eco Additions
Pty Ltd, or www.ecoadditions.com.au
"the Website" refers to www.ecoadditions.com.au
"goods, products, Products, Product" refers to any Product, service or accessory sold to You
pursuant to this contract by Eco Additions Pty Ltd
"orders, order" refers to any offer made by You to purchase Product, service or accessory from
Eco Additions Pty Ltd
"commercial use, business use" refers to the use, hire, sale or lease of any Product, service or accessory sold to You by Eco Additions Pty Ltd
"agreement, contract" refers to a contact of sale for any Product, service or accessory sold to
You, incorporating these Terms and Conditions.
"Your acceptance" the purchase of goods from Eco Additions shall be deemed as acceptance by
You of these Terms and Conditions.
If You do not agree to be bound by these Terms and Conditions You should not proceed any further.
ACCEPTANCE OF TERMS
You acknowledge that You are aware of the terms of the Contract and agree to be bound by them.
You agree to be bound by the Terms and Conditions set out herein and You accept our privacy
policy available at www.ECOADDITIONS.com.au/privacy.htm . Any product sold subject to this Contract is to the exclusion of any other terms and conditions stipulated or referred to by You. You acknowledge that You are aware of the content of and agree to be bound by this.
If You object to any of the Terms and Conditions set out in this agreement You should not use any of the Products or services from Eco Additions Pty Ltd and you should not proceed any further.
Only once an order has been accepted by us, and you have received notification of this acceptance will this contract come into effect. No Contract shall come into existence until Your Order has been accepted by Us and notification acceptance has been received by You.
We reserve the right to reject any Order at anytime, prior to acceptance of that Order by Us.
You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the Terms and Conditions set out in this agreement.
No amendment or variation to this contract shall be binding on us unless confirmed in advance in writing by an authorized Director of Eco Additions Pty Ltd.
Eco Additions Pty Ltd reserves the right to change, modify or remove any part of this agreement without notice and without warning or liability arising from such action.
Before any Product is bought by You for any Commercial use You must first obtain written approval / consent from Eco Additions Pty Ltd. Approval may be granted or withheld by Us for any reason and may be subject to further conditions.
DELIVERY, TITLE AND RISK
Subject to the terms of the Contract, We shall deliver the Product ordered to the delivery address that was specified by You at the time of the Order being placed. Please note that we cannot deliver to PO Box addresses.
Delivery, postage, handling and insurance shall be subject to the terms and conditions of the relevant carrier. Once you have placed your order you should receive an order / delivery confirmation by email within 24-48 hours. If you do not receive this confirmation, please contact us immediately to ensure we have your order. We dispatch your order within 24-72 hours of order.
Delivery charges are charged by weight. We use Australia Post for all our deliveries.
You will be informed of all delivery charges at the time of purchase, before you proceed to pay for your product. If we are out-of stock you will be notified immediately. You can choose to postpone your order, or cancel if you prefer.
If in exceptional circumstances, your product has not been shipped within seven days of receiving your order we will contact you to explain the delay and to get you to authorise the transaction.
Should You or Your designated representative be unavailable to accept delivery of the Product ordered, or if sufficient information is not provided to enable suitable delivery of the Product, Eco Additions or its agent shall be entitled to store and/or arrange for subsequent delivery of the Product. In this event, title and risk in the Product shall be deemed to have passed to You upon attempted delivery to the Product and notice of the attempted delivery to You, and You shall be liable for any additional costs incurred in storage and/or subsequent delivery of the Product.
Title and risk in the Product shall pass to You upon delivery of the Product to You.
Unless the You notify Us in writing within 48 hours of delivery (and We receive such notification within 96 hours of delivery), the Product shall be deemed to have been delivered in full, in good condition and in accordance with this Contract.
Any damaged or incomplete deliveries must be reported to us within 48 hours of you receiving the goods. Please save the packaging and send us as much evidence as you can (eg photos, descriptions etc).
All goods are Quality checked before shipping. In the unlikely event of a product defect, please contact us in writing. Any liability We may have for a defective Product or the non-delivery of a Product shall be limited to Us, in Our sole discretion, either replacing the Product within a reasonable time or to refund any monies in respect of the Product.
